At Watkins, Lourie, Roll & Chance, many of the cases that we see and we handle are wrongful death cases. Those include cases in which a child has lost a parent. In the case of a minor child who has lost a parent due to the negligence of others, then the child has rights to recover damages for wrongful death. However, the child is usually not the one who brings the cause of action. In fact, under Georgia law when a parent is killed due to the negligence of another, then the surviving spouse brings the claim and files the lawsuit on behalf of the surviving spouse, and on behalf of any surviving children. And during the lawsuit, if there is a recovery, then the spouse holds that money for the benefit of any of the minor children.
