If you have a wrongful death case in the state of Georgia, there are two separate and distinct claims that arise. One claim is brought on behalf of the estate of the decedent for their pain and suffering prior to death, medical expenses, funeral and burial expenses and imputative damages. The wrongful death survivor, typically a spouse, son or daughter, brings a separate claim for the full value of the life of the decedent. That includes an economic component and a non-economic component. The economic component is a function of lost wages into the future.
