Transcript: People hear this term wrongful death and then wonder what that is. Under Georgia law, wrongful death is a death that is caused due to the negligence or other wrong doing of another. And the law here in Atlanta and in Georgia provides a way that individuals who have a family member who has been killed as a result of the negligence or other wrong doing can recover damages. And those damages are called wrongful death damages. In Georgia, those damages are described as damages for the full value of the life of the person who has died. And that includes both tangible and intangible damages.

The tangible damages are the money that the person who died would have made over their lifetime so that they can support their family. The intangible damages are things like the joy of looking at your children, the joy of being married, the joy of seeing a sunrise every morning. The experience of living and all that goes with it. And those damages from wrongful death are determined by the enlightened conscious of the jury.
